DOE Issues Final Rule on Grid Security Emergency Orders: Procedures for Issuance

On January 10, the U.S. Department of Energy (DOE) issued a final rule establishing procedural regulations concerning the Secretary of Energy's issuance of an emergency order under section 215A of the Federal Power Act which was added in 2015 with the passage of the Fixing America’s Surface Transportation Act or FAST Act. Under section 215A(b), if the President of the United States declares a “grid security emergency” the statute authorizes the Secretary of Energy to order emergency measures to protect or restore the reliability of critical electric infrastructure or defense critical electric infrastructure during the emergency. DOE published a notice of proposed rulemaking in the federal Register on December 7, 2016. The procedures established by the final rule guarantee the expeditious issuance of emergency orders under the Federal Power Act.
